In accordance with the User Agreement and Adhesion Agreement posted on the Website and Sun.rent Application, this Privacy Policy (hereinafter referred to as the Policy) applies to all information that Sun Rent Limited Liability Company (hereinafter referred to as the Company) receives about the User during the registration, authorization, and other use of the Website, Sun.rent Application, and Sun.rent Service. The User’s consent, as stated in the Policy, for the Company to process personal data and other information provided by the User is deemed to have been given concurrently to the third parties listed in the Policy who have been hired by the Company to help carry out the User Agreement and the Adhesion Agreement. The User agrees to the terms and conditions of the Policy and the processing of his or her personal data and other information specified therein by using the Website, Sun.rent Application, and Sun.rent Service (including registration and authorization); if the User disagrees with the Policy and all of its terms and conditions, the User will not use the Website, Sun.rent Application, or Sun.rent Service.
1. The Company receives and processes the User’s personal data and other information.
1.1. When registering, authorizing the User, and using the Website, Sun.rent Application, Sun.rent Service, making payments, conducting surveys, sending information and advertising messages, and in all other cases provided for by the User Agreement and the Accession agreement, the Company may request from the User (clause 1.1.1. of the Policy) and/or automatically receive the following information about the User (clause 1.1.2. of the Policy):
1.1.1. Name, surname, mobile phone number, e-mail address, login and password information for access to certain functions of the Website, Sun.rent Application, Sun.rent Service, history of using Sun.rent Service (information about the number, cost, time, and order of orders made by Users for Sun.rent Service services and payment, including data on bank account and/or bank card account), information about participation in promotional events, information about subscribing.
1.1.2. Information that is automatically transmitted to the Company while using the Website, Sun.rent Application, Sun.rent Service, using the software installed on the User’s device, including IP address, information from cookies and tracking bugs, information about the User’s country and/or city of location, information about the User’s Internet browser (or other programme with which the User accesses the Website, Sun.rent Application, Sun.rent Service), access time, address of the requested page, information about the User’s devices with which the User accesses the Website, Sun.rent Application, Sun.rent Service, access time, address of the requested page, and information about the User’s devices with which the User accesses the Sun.rent Service.
1.2. This Policy is only applicable to the Website, Sun.rent Application, and Sun.rent Service. The Company has no control over and is not responsible for any third-party websites or software that the User may visit via links on the Website, Sun.rent Application, or Sun.rent Service. Other third-party websites may collect or request additional information from the User, as well as execute other acts for which the Company is not responsible.
1.3. The Company assumes that the User is a legally capable adult who follows the terms of the User Agreement and the Accession Agreement, provides accurate and adequate information, and keeps this information up to date. The Company reserves the right to verify the information submitted by the User in line with the terms of the User Agreement and the Accession Agreement. If the User supplies inaccurate information, the Company reserves the right to suspend or cancel registration and/or prohibit the User access to the Website, Sun.rent Application, and Sun.rent Service. The Company and/or other third parties are not liable for any erroneous information provided and the resulting negative effects. If a juvenile and/or incapable person uses the Website, Sun.rent Application, or Sun.rent Service, the minor and/or incapable person’s parents, adoptive parents, and other legal representatives are accountable for such unauthorised use.
2. Purposes of collecting and processing data and other information about the user.
2.1. The Company uses the User’s data and other information for the purposes of conclusion and execution of the User Agreement, conclusion and execution of the Accession agreement, provision of additional services, improvement of service quality, participation of the User in promotions, surveys, research (including, but not limited to surveys, research via electronic, telephone, and cellular communication) conducted by the Company, making decisions, or performing other actions. The indicated purposes for personal data usage apply to all of the information specified in clause 1.1 of the policy.
2.2. The reasons for collecting and processing personal data include, without limitation, the following:
2.2.1. Registration, identification, and authorization of the User within the Sun.rent Service;
2.2.2. Conclusion and execution of the User Agreement and Accession agreement;
2.2.3. The Sun.rent Service and any additional capabilities within it are made available to the user;
2.2.4. The Company processes user requests within the framework of the Sun.rent Service;
2.2.5. Analysing and researching opportunities to improve the Sun.rent Service;
2.2.6. Sending news and information about products, facilities, special offers related to the Sun.rent Service;
2.2.7. Sending out service messages (e.g., to inform about the scooter rental status, to restore/change the User’s login and password, etc.).;
2.2.8. Preventing and detecting fraud and illegal use of the Sun.rent Service;
2.2.9. Conducting statistical and other studies based on anonymised data.
3. Terms, methods and procedure of processing personal data and other personal information of the User.
3.1. The Company uses the User’s personal data and other information only for the reasons described in the Policy, in line with the Policy.
3.2. The Company respects confidentiality of personal data and other information of the User.
3.3. The Company will not disclose to third parties, distribute, sell, or otherwise dispose of personal data and other information obtained, except for the purposes, means, and to the extent specified in this Policy.
3.4. The Company processes the User’s personal and other data to the extent required to achieve each of the purposes specified in Section 2 of the Policy, in the following possible ways: collection, recording (including on electronic media), systematization, accumulation, storage, compilation of lists, labelling, specification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction. The Company has the right to process the User’s personal and other data, both automatically and manually.
3.5. The Company reserves the right to transfer the personal data provided to it by the User for processing (give an order for processing) (to the extent necessary for the Company to fulfil its obligations) to third parties, including organizations engaged by the Company to carry out informational sending of messages via e-mail/mobile operators, debit/credit money from/to the bank card(s)/settlement account – credit organizations (banks), payment systems, mobile operators.
3.6. In addition, the Company reserves the right to send personal data given by the User to state authorities, courts, and other approved entities and organizations as required by relevant legislation.
3.7. The Company assures the fair and lawful processing of the User’s personal and other data in accordance with the purposes specified in Section 2 of the Policy.
3.8. The Company assures the immediate updating of the User’s data if the User provides the updated data.
3.9. The User consents to the processing of personal data and other data indefinitely, or until the expiry of the storage time for the relevant information or documents containing the aforesaid information, as determined by the applicable law to the Policy. The Company will erase the personal data after the specified time limit has expired.
4. Modification or deletion of information by the User. Withdrawal of consent to the processing of personal data.
4.1. The User may at any time change (update, supplement) the personal data and other information provided by the User by contacting the Company, for example, through the support service or using the contacts indicated on the Website, in Appendix Sun.rent with a request to change (update, supplement) the information previously provided by the User (the Company changes (updates, supplements) the information provided by the User only after the identification procedure applied in the Company at the time of the relevant request).
4.2. The User has the right to withdraw his/her consent to the processing of personal data by sending a written notice to the Company at least 30 (thirty calendar) days prior to withdrawal of consent, in which case the User acknowledges and understands that access to the Sun.rent Website and Sun.rent Application, as well as Sun.rent Service, will be denied by the Company as of the moment the Company is no longer able to process the User’s personal data.
5. Protection of Users’ information.
5.1. The Company ensures that the necessary and sufficient organizational and technical measures are in place to protect Users’ personal data and other information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, and other unlawful actions by third parties.
6. Cookies.
6.1. To improve the quality of the Sun.rent Service, the Company may use (temporary and permanent) cookies, tracking bugs and/or other technologies to collect non-personally identifiable data (e.g., IP address, browser type and Internet Service Provider (ISP) data, as well as (for Users who use the Company’s services via a mobile device) a unique device identifier, operating system data and coordinates in order to record the number of Users and their behaviour when using the Sun.rent Service. To improve the convenience of Users, the Company has the right to collect and process information about the total number of transactions, pages viewed by the User, referring/source pages, type of platform, date/time of recording information, number and location of views of a given page, page views and used (search) words.
6.2. Cookies and tracking bugs information:
6.2.1. A cookie is a small text file that is transmitted to the User’s device browser from the Company’s server. Cookies save information that the Company may use in the future. This information will be stored by the browser and sent back to the Company with each request made by the user. Some cookie values can only be retained for a single session and are destroyed when the browser is closed. Others, set for a specific time period, are written to a particular file on the hard drive and saved on the user’s device. Cookies are used to identify users, track sessions (state maintenance), and store information about them, such as preferences, when they use the Sun.rent Service. Cookies used by the Company only collect anonymous information.
6.2.2. Tracking bugs are graphical elements inserted in web pages or e-mail messages. Tracking bugs are used for a variety of purposes, including reporting on the number of users. The tracking bugs deployed by the Company capture solely anonymous data.
6.3. The Company may use cookies and tracking bugs to monitor the use of the Sun.rent Service, collect non-personal information about the User, store preferences and other information on the User’s device in order to save the User’s time entering the same information in the Website, Sun.rent Application forms, and display the content during the User’s subsequent visits to the Website, Sun.rent Application. The Company’s Privacy Policy may also utilize information gathered through cookies and tracking bugs for statistical research with the goal of tailoring the content of the Website, Sun.rent Application to the User’s preferences.
6.4. The Company may allow the User to adjust the settings for accepting cookies and tracking bugs in their browser settings or disable them completely; however, in this case, some functionalities of the Sun.rent Service may not work effectively.
7. Making changes to the Policy. User’s consent to the Policy.
7.1. The User acknowledges and agrees that by registering on the Website, the Sun.rent Application, and using the Sun.rent Service, any of its services, or functionality, the User unconditionally agrees to all clauses of this Policy and unconditionally accepts its terms and conditions.
7.2. The User’s continued use of the Sun.rent Service following any modifications and/or amendments to the Policy shall indicate that the User agrees to such changes and/or amendments.
7.3. The User agrees to frequently familiarize himself or herself with the contents of the Policy in order to timely familiarize himself or herself with its changes/additions.
7.4. The Company maintains the right, at its discretion, to amend and/or supplement the Policy at any time without prior or subsequent notice to the User. The new edition of the Policy takes effect when it is posted on the Website and/or in Appendix Sun.rent, unless the new edition of the Policy states otherwise. The latest version of the Policy is always available on the Website and/or in the Sun.rent Application. Dear User, if you do not agree with the Policy, please do not use the Website, the Sun.rent Application, or the Sun.rent Service.
8. Final Clauses.
8.1. The legislation of the Russian Federation shall govern the Policy and any relations between Users and the Company that arise as a result of its application.
8.2. By consenting to the Policy’s terms and conditions, the User consents to the processing of personal and other data at his or her own discretion and in his or her own best interests.
8.3. The refusal to give personal data and other information required for the use of the Site, the Sun.rent Application, and the Sun.rent Service prevents the Company from providing the Sun.rent Service to the User.
